Not enough infomation given. What was the looter stealing, was the looter armed or pose a creidable threat to the officer in question.
Looting is a crime just like, speeding is a crime, theift is a crime, ect.
Law enforcement have rules on when lethel force can be used. If the officier showes that he was in reasonable danger of there life or the life of an innocent bystandard then the officier was right in using such force. On the other hand if its some poor woman with a child leaving a destoryed store with some milk and diapers and an officer shoot's her, then the officer should fry.

Fox, actually the law is black and white. The rule is that the police in the USA cannot kill to protect property. In fact, the only time property can be protected by use of deadly force is area 51 and nuclear. Obviously if the threat becomes life threatening to the officer than it can be used.

We're talking about people taking no consumable goods for profit.
Trust me, you might here of a few good looters, but most down there are taking anyting of value that they can for profit. I don't think taking the necessitys is considered looting.
OK, for the purpose of this poll, lets use this. The looter is coming out of a personal residence, known not to be associated with the residence, and is in possession of the homes safe where it is known to contain valuables.

Brad, the law is never black and white. There are defenses that can be used to aquit any defendant. If the suspect was caught only with an armful of diapers and baby formula he can claim preservation, but if he was stealing plasma tv's the defense doesn't stand.

You pretty much answered your own question. I am not defending the profiteer's here, If I was on a jury for a person that had looted peoples homes I would convict them of as many charges as possable.
However in the case you refrence, I could ask does a police officer have the right to shoot anyone he catches anywhere leaving a house with stolen goods. Answer is NO, and there is no diffrence in this case. We live in the U.S under the stars and stripes. As soon as you condone a police officer excuting someone, and in this case if there is no danger to himself or anyone else then it is an excution by the police. We might as well run up the Hammer and Cycle over the white house and let the secret police take care of everyone. Eh Commrad.
Looter's and disater profiteer's are scum, but they still have the right to due process of law like all other citizens. but once they have been treated faily via due process, throw the book at them.

Taking stuff just to take it, during a time like this, ought to be a capital offense. :D
The question is about a trial for a cop that kills a looter? I had my mind all made up that all looters should be shot until a saw a woman on TV last night that was confronted by a news reporter. The woman had four or five big packages of stolen pampers. She had a look of agony on her face and tears streaming down as she said "Yes! I know it's wrong, but my baby needs these and who am I going to pay?"
OK....... if the cop sees someone carrying off merchandise from a store is he going to interrogate the looter before he shoots? Does he have time to say "Pardon me, but do you need that or are you going to sell it? And if you are going to sell it, are you going to use the money to help your family? Or were you just gonna get yourself a fix? OK, MY call.......BANG!
Stealing is wrong. Period. But I wouldn't want to be the cop enforcing martial law right now and having to make the choice to shoot or not.
