eBay advice
  Hi there, just looking for some advice really.
I bought a phone from Hong Kong. After a month it had not arrived and then seller agreed to refund me the money I had paid on the basis that I returned the phone if it ever showed up. I agreed to this and went out and bought a new phone.
The phone then arrived and I told the seller I was sending it back to him in exchange for the already promised refund. He agreed. I have posted the phone with tracking and supplied the tracking and refund details numerous times but he is giving me the run around asking the same questions over and over. I dont think I am going to get the refund.
Is there anything I can do? I hadn't filed an item not received before the phone arrived.

If you can prove that he has received the phone - a signature for delivery is what I mean - you can claim your funds back via Paypal. If you didn't pay by paypal or can't prove that have returned it back safely, I think you might be goosed. :(
To claim via Paypal - you just find your transaction on your account & then click through to the resolution Centre and Open an Item dispute. You will need to give as much info as possible to state your case including tracking numbers etc. You have to file a claim upto 45 days after payment.

Thanks a million for your reply. I'm at 41 days now so if I don't receive payment by tomorrow I will file a complaint.
